Criminal & DUI Credentials

Attorney Humphrey is a Nationally Recognized DUI Attorney. He is a member of the National College for DUI Defense ("NCDD") and a Founding Member of the DUI Defense Lawyers Association ("DUIDLA"). Recently, he was appointed the DUIDLA Ambassador for the State of Rhode Island.

Attorney Humphrey is a recognized leader in the areas of criminal law, DUI defense, and sex crimes because of his litigation experience, articles, and lectures. He is a frequent lecturer for the Rhode Island Bar Association and other educational programs. In 2023, Attorney Humphrey lectured for the Rhode Island Bar Association on "Hardship Licenses & DUI Cases." In 2020, Attorney Humphrey conducted a DUI training seminar for the Rhode Island Public Defender's Office and the Rhode Island Association of Criminal Defense Lawyers. In 2017, Attorney Humphrey continued his prolific publishing with the article "Rhode Island DUI Conditional Hardship Licenses: The Sequel". Attorney Humphrey has published twenty (20) articles in the Rhode Island Bar Journal on criminal law, DUI and sex crimes topics.

Attorney Humphrey prepared Rhode Island's DUI Practice Manual entitled Drunk Driving : Detection, Prosecution and Defense (2023 Update) which is widely used by drunk driving law practitioners in courtrooms throughout the State of Rhode Island.

JUDICIAL EXPERIENCE

Since August of 1996, Attorney Humphrey has served as a Newport County Bail Commissioner. Bail Commissioners serve a vital role in our system of justice because they have the responsibility to act as a neutral magistrate at the initiation of criminal proceedings, to make probable cause determinations, to set and take bail at special arraignments, to sign arrest warrants, and to commit individuals to the Adult Correctional Institution "ACI".

Attorney Humphrey has served as the Municipal Court Judge for the Town of Tiverton. As the Municipal Court Judge, he has original jurisdiction to hear and to decide cases involving local minimum housing standards, traffic violations, and zoning issues.

From 2006 to 2011, Attorney Humphrey served on the Sex Offender Board of Review. The Board is charged with the duty to determine the level of risk a sex offender poses to the community and to assist the Sentencing Court in determining if the offender is a sexually violent predator. PROSECUTORIAL EXPERIENCE

For fourteen (14) years from April of 1994 to January of 2008, Attorney Humphrey served as the Assistant Solicitor for the Town of Little Compton and his duties included prosecuting misdemeanor offenses such as drunk driving and domestic violence that were committed within the Town. Attorney Humphrey also represented the Town before Newport County Superior Court and advised the Town Council and Zoning Board of Review.

From December of 2002 to January of 2005, Attorney Humphrey served as the Assistant Solicitor for the Town of Portsmouth and handled misdemeanor prosecutions and occasionally zoning matters for the Town.

Attorney Humphrey also served as a Special Prosecutor for the prosecution of drunk driving and domestic violence cases in the Towns of Burrillville, Middletown, and Portsmouth.

From October of 1994 to the present, Attorney Humphrey has published twenty (20) articles, ten (10) of which articles he has coauthored, in the Rhode Island Bar Journal on criminal law, DUI and sex crimes topics. The topics of these articles have addressed such topics as domestic violence, drunk driving/refusal, probate appeals, and sex crimes.
