Is a DUI a Misdemeanor in Rhode Island?

Pursuant to Rhode Island General Laws 31-27-2 (drunk driving statute) states whoever drives or otherwise operates any vehicle in the state while under the influence of any intoxicating liquor, drugs... or any combination of these, shall be guilty of a misdemeanor.

How is a DUI Determined?

For the Prosecution to successfully prove a DUI case in Rhode Island against a suspected drunk driver, the State must establish the following:

  1. That there was reasonable suspicion to stop the suspected drunk driver's vehicle, which is usually based on traffic infractions. Anonymous tips alone that a driver may be operating his/her vehicle while intoxicated is not enough for a valid vehicle stop.
  2. That the suspected drunk driver was operating a vehicle. Operation of the vehicle is often an issue in accident cases.
  3. That probable cause existed to arrest the suspected drunk driver. Probable cause to arrest is based on the police officer's observations of the suspect's driving, the indicia of alcohol, and most importantly the suspect's performance during the administration of the standardized field sobriety tests. Any deviation in the administration of the National Highway Traffic and Safety Administration ("NHTSA") standardized field sobriety tests may result in these tests becoming inadmissible as evidence.
  4. That the suspected drunk driver was under the influence of intoxicating liquor and/or drugs to a degree which rendered him/her incapable of safely operating a vehicle. The State can prove that an operator of a vehicle was under the influence of liquor and/or drugs by use of either chemical test results and/or observation testimony. There are numerous requirements that the State must comply with before chemical test results or observation testimony is admissible.
  5. That the suspected drunk driver was afforded a reasonable opportunity to have a physical examination by a physician selected by him/her pursuant to R.I.G.L. 31-27-3.

"He saved my job and my reputation."
I work in the medical field and feared for my job after I was involving in a DUI motor vehicle accident and arrested for felony drug possession. Attorney Humphrey was recommended to me by a friend who said he was a great lawyer. I could not have been happier with his work on my case. He got the drug charges dismissed and I can now have the case removed from my record. He saved my job and my reputation.
    - Donna
"I went from a felony, going to jail, to a misdemeanor!"
I would like to give a testimonial about the fabulous job Robert and Kim did for me. Robert made motions and got my sentence reduced to such a very minor, as in misdemeanor, when I could have been facing a felony! Robert worked with Kim and talked with the judge and the AAG to get my sentence reduced, saved my driving record and my use of an ignition breath machine. His motions were so thought out and after looking at the tape, we came up with 2 more. I cannot thank him or his team for keeping me informed, educated about the circumstances and decisions I would have to make. I could not have asked for a better lawyer or team than his. I went from a felony, going to jail, to a misdemeanor! The man who wrote the book proved to me, he knew what he was doing and I am thankful for him and all of his team.

"He is, in a word, the best."
I was arrested by the Police and charged with DUI and Refusal. I could not have any criminal record and still keep my job. I knew I need an attorney who was highly skilled in drunk driving defense. Attorney Humphrey thoroughly examined my case and because of his experience, he was able to get the DUI dismissed and then expunged. The Refusal charge was scheduled for a trial date, but immediately before trial, it too was dismissed. Although it was an unfortunate incident, I am grateful to Attorney Humphrey for his hard work and dedication to my case. I would absolutely recommend him to anyone who was charged with DUI. He is, in a word, the best.

    "Attorney Humphrey is truly exceptional!"
As a college student pursuing a degree in finance, my life was turned upside down when the Providence Police arrested me for a felony. I knew this would have detrimental consequences on my future career and my ability to get into graduate schools. I met with Attorney Humphrey and immediately felt at ease with his professionalism and knowledge of the law. He resolved my case effectively and efficiently, the felony was dismissed, I never sustained a criminal conviction and I never lost my license. My family and I are so thankful for his work on my case. Attorney Humphrey is truly exceptional!

"I would strongly recommend Attorney Robert Humphrey"
Immediately upon returning from my recent combat deployment to Afghanistan, I was charged by the Cranston Police with drunk driving. I was very concerned about the effect a criminal conviction and a loss of license could have on my military career. I was fortunate Attorney Humphrey agreed to take my case. Because of his reputation and the high esteem both the Court and the Prosecution have for him and his legal abilities, my drunk driving with high Breathalyzer test results case was amended to reckless driving. This is great because I never received a criminal conviction and I never lost my license. I would strongly recommend Attorney Robert Humphrey to anyone who needs a great DUI lawyer in Rhode Island.

"he treated it as an important case and got me a good settlement."
I was in a car accident on the way home from work. Although my case wasn't "a big case" according to other lawyers, it was important to me. My husband immediately contacted Bob and he treated it as an important case and got me a good settlement.
