Is a DUI a Misdemeanor in Rhode Island?

Pursuant to Rhode Island General Laws 31-27-2 (drunk driving statute) states whoever drives or otherwise operates any vehicle in the state while under the influence of any intoxicating liquor, drugs... or any combination of these, shall be guilty of a misdemeanor.

How is a DUI Determined?

For the Prosecution to successfully prove a DUI case in Rhode Island against a suspected drunk driver, the State must establish the following:

  1. That there was reasonable suspicion to stop the suspected drunk driver's vehicle, which is usually based on traffic infractions. Anonymous tips alone that a driver may be operating his/her vehicle while intoxicated is not enough for a valid vehicle stop.
  2. That the suspected drunk driver was operating a vehicle. Operation of the vehicle is often an issue in accident cases.
  3. That probable cause existed to arrest the suspected drunk driver. Probable cause to arrest is based on the police officer's observations of the suspect's driving, the indicia of alcohol, and most importantly the suspect's performance during the administration of the standardized field sobriety tests. Any deviation in the administration of the National Highway Traffic and Safety Administration ("NHTSA") standardized field sobriety tests may result in these tests becoming inadmissible as evidence.
  4. That the suspected drunk driver was under the influence of intoxicating liquor and/or drugs to a degree which rendered him/her incapable of safely operating a vehicle. The State can prove that an operator of a vehicle was under the influence of liquor and/or drugs by use of either chemical test results and/or observation testimony. There are numerous requirements that the State must comply with before chemical test results or observation testimony is admissible.
  5. That the suspected drunk driver was afforded a reasonable opportunity to have a physical examination by a physician selected by him/her pursuant to R.I.G.L. 31-27-3.

My faith has increased tenfold because of your representation. When I was charged with drunk driving, refusal, and numerous traffic violations, my life had taken a turn for the worst. All that changed when I spoke with an attorney who referred me to you because of your reputation in the legal community for excellence. Your efficient and successful resolution of my cases before both the District Court and the Traffic Tribunal is further evidence that I am truly blessed. I want everyone to know what you have done for me.

"We would highly recommend you to any family"
On behalf of Megan and myself, I wanted to thank you for your excellent representation of her with her Richmond DUI charge. You were always available for both of us to answer our questions. You did an excellent job in getting her extremely high breath test results suppressed so she could get a great disposition. We would highly recommend you to any family with a Rhode Island criminal charge.
    - Richard & Megan

"You were both professional and supportive at a difficult time."
We would like to thank you Mr. Humphrey, and your staff for all your hard work in our daughter's legal case. You were both professional and supportive at a difficult time. As parents, it was very reassuring to receive the correspondence and frequent updates. She learned a great deal from this experience, as well. It was wonderful to receive your last letter indicating that her record was expunged. Thanks again.
    - Marie

My family and I were greatly concerned when I was charged with a crime after an automobile accident. Especially because I am on a scholarship at a local college. My sister found Attorney Humphrey online and he was great. He was able to quickly resolve the case so I did not receive a criminal conviction. I am going to tell all of my college classmates that if you get in trouble, Robert Humphrey, Esq., is the best Rhode Island attorney to call.
