Probation Officer Sentenced in Child Pornography Case

As reported by Katie Mulvaney in the June 28, 2014 edition of the Providence Journal, a probation officer has been sentenced in connection with possession of child pornography case. The man was found guilty of one (1) count of possession of child pornography and six (6) counts of receiving child pornography. He was sentenced to six (6) years imprisonment, sex offender counseling and mental health counseling. Upon his release, he will have fifteen (15) years of probation and must register as a sex offender. This was a federal case and the man was arrested after he ordered videos containing child pornography.

Pursuant to Rhode Island General Laws 11-9-1.3, it is a violation of this section for any person to:

(1) Knowingly produce any child pornography;

(2) Knowingly mail, transport, deliver or transfer by any means, including by computer, any child pornography;

(3) Knowingly reproduce any child pornography by any means, including the computer; or

(4) Knowingly possess any book, magazine, periodical, film, videotape, computer disk, computer file or any other material that contains an image of child pornography.

The penalties if convicted of receiving child pornography include a fine of not more than five thousand dollars ($5,000), or imprisoned for not more than fifteen (15) years, or both. The penalties if convicted of possessing child pornography include a fine of not more than five thousand dollars ($5,000), or imprisoned not more than five (5) years, or both.
