Newport Missing Child Leads to Marijuana Arrest

As reported in the November 29, 2012 edition of turn to 10.com, a Newport man has been arrested and charged with manufacturing marijuana. The man called police because his young daughter was missing. The police responded to his home to search for the girl. In this basement, police found nearly thirty (30) marijuana plants. The girl was later found.

Pursuant to Rhode Island General Laws 21-28-4.01(a) it shall be unlawful for any person to manufacture, deliver, or possess with intent to manufacture or deliver a controlled substance. Possession of small amounts of marijuana is punishable by imprisonment for not more than one year or fined not less than two hundred dollars ($200) nor more than five hundred dollars ($500), or both.

However, based on the number of marijuana plants seized, the man was found to be in possession of one (1) to five (5) kilograms of marijuana. Pursuant to R.I.G.L. 21-28-4.01.1, it shall be unlawful for any person to manufacture, sell, or possess with intent to manufacture, or sell, a controlled substance classified in schedules I or II or to possess or deliver the following enumerated quantities of certain controlled substances:

(5) One kilogram (1 kg.) to five (5 kgs.) kilograms of a mixture containing a detectable amount of marijuana.

The penalties if convicted include imprisonment for a term up to fifty (50) years and fined not more than five hundred thousand dollars ($500,000).
