Attorney Robert H. Humphrey in Rhode Island Lawyers Weekly

In the November 28, 2011 edition of Rhode Island Lawyers Weekly, Robert H. Humphrey, Esq., a leading criminal defense attorney in the State of Rhode Island and former prosecutor, was prominently quoted with regards to privacy concerns related to GPS technology. The article quotes Attorney Humphrey as saying "I think the court, by taking this case, is showing that they are concerned with keeping up with the changing technologies. Technology is on the cutting edge, but the court takes a longer view of it when it comes to privacy rights." The case which is currently before the U.S. Supreme Court involves the limits of police officers' warrantless use of GPS technology to track a suspect's movements. With regards to the government's argument that drivers have no expectation of privacy on public streets and that GPS surveillance is no more intrusive than being tailed by a police car, Attorney Humphrey stated "we have a certain expectation of privacy once we get into our cars. Although we are in public, for many people cars are an extension of our home." The issue of GPS tracking and other advances in technology will have to be weighed against the rights of our citizens by the U.S. Supreme Court.
