As reported in the November 23, 2010 edition of the Providence Journal, two (2) Rhode Island men were sentenced in federal court for child pornography. Both men appeared before the U.S. District Court on charges of online trading of child pornography.
One man received a sentence of five (5) years in prison, a $5,000.00 fine and was ordered to pay restitution to his victims. The other man was also sentenced to five (5) years in prison and ordered to pay restitution. The men were arrested as part of an investigation by the Rhode Island State Police. Both of their computers were found to contain pornographic videos of children. Ten (10) other people were also arrested as part of this investigation.
Pursuant to Rhode Island General Law, 11-9-1.3,
It is a violation of this section for any person to:
(1) Knowingly produce any child pornography;
(2) Knowingly mail, transport, deliver or transfer by any means, including by computer, any child pornography;
(3) Knowingly reproduce any child pornography by any means, including the computer; or
(4) Knowingly possess any book, magazine, periodical, film, videotape, computer disk, computer file or any other material that contains an image of child pornography.
The penalties for producing child pornography are greater than possessing child pornography. The penalties for possession of child pornography include a fine of not more than five thousand dollars ($5,000), or imprisoned not more than five (5) years, or both.
