Rhode Island Domestic Violence Attorney

Domestic Violence Lawyer in RI

Over the past several years there has been heightened public awareness of the serious consequences of domestic violence and in response the Rhode Island legislature enacted the Domestic Violence Prevention Act (R.I.G.L. 12-29-1) to thwart the disparate treatment of violent crimes occurring between family or household members and the same crimes occurring between strangers.  Pursuant to R.I.G.L. 12-29-2, domestic violence is defined as including, but is not limited to, any of the following offenses when committed by one family or household member against another:  simple assault, felony assault, vandalism, disorderly conduct, trespass, kidnapping, child snatching, sexual assault, homicide, violation of a protective order or a no contact order, stalking, and refusal to relinquish, damage or obstruction of a telephone.  The definition of “family or household member” is broadly written to reflect the diverse nature of the modern American family and includes persons who are or have been in a substantive dating or engagement relationship.

Pursuant to Rhode Island law, when a police officer responds to a domestic violence call and the officer believes that probable cause exists that a crime has occurred, he is required under Rhode Island law to make an arrest.  Therefore, if you are charged with a crime of domestic violence, you need a domestic violence attorney who has the reputation, experience and skill to successfully handle your domestic violence case.

Attorney Humphrey has over fifteen (15) years experience as a criminal defense attorney and fourteen (14) years experience as a municipal prosecutor and special prosecutor handling domestic violence cases.  As a result of his knowledge in the area of domestic violence, he has lectured on the topic for the Rhode Island Bar Association and other educational programs and he has published two (2) articles, “The Law of Domestic Violence in Rhode Island” and “Domestic Violence: Detection, Prosecution and Defense” in the Rhode Island Bar Journal.  Allow Attorney Humphrey’s reputation, experience and skill to successfully guide you through the legal process when you have been charged with a domestic violence crime.
